Senior lawyer of the Supreme Court and one of the members of the constitution drafting committee. Kamal Hossain said that the constitution is for the people. People can protect it. A person may be mistaken. It is not wrong if one person thinks so. If there is a consensus among the citizens in the changed situation, then it can be said that amendments are needed. It cannot be tampered with in any way. No one can do that with the stroke of a pen. People's opinion should be taken. If the majority vote, then the constitution can be signed.
On the occasion of the Constitution Day, Dr. said these things in the discussion meeting organized at the Supreme Court Lawyers Association Auditorium today. Kamal Hossain. Democratic Lawyers Association organizes this discussion meeting.
Professor Syed Anwar Hossain, senior lawyer Subrata Chowdhury, Dr. Shahdeen Malik and others.
In the speech of the chief guest. Kamal Hossain said, we will build such a consensus. So that if I make a mistake, I can point it out. People should be careful. Whenever there seems to be a mistake, we can compel the government to correct the mistake.
He said that the people should actively play the role of guardians. How the state is governed, how the constitution is interpreted. Correct interpretation or misinterpretation – people should be careful and aware about that. If it is not explained properly, it must be conveyed. The Supreme Court interprets the Constitution. Courts can also make mistakes.
He also said that the people are the owners of the country. If people understand that it is wrong, if there is a greater consensus, then if it is wrong, it can be corrected. An alert population is the main force. If the people are careful then the constitution can be properly interpreted. Can be kept on the right track.
Supreme Court Bar President Barrister AM Mahbub Uddin Khokon said, the Constitution will not be amended, it will be rewritten – I think this debate is leading the nation to a crisis. As a political activist, I see many clouds in the sky ahead. That is until the election. There are many conspiracies going on. Instability may arise, electoral system may be stopped. Many people think that they will write a new constitution. Now if the constitution is amended or rewritten who will approve it? Future Parliament? If not? So what will win them during the election? Who will approve it? Then the pain of 16 years remained.
Barrister Khokon said, this Supreme Court has ever said martial law is illegal? After leaving, he said he did wrong. What has happened in the last 16 years. Now they are being tried. Why does the Supreme Court not have the courage? If the Supreme Court had been brave, we would not be in this misery today.
Expressing his anger that the law was not enacted for the appointment of judges, he said that he cannot apply if he is in the third class at the time of appointment of a judge in the lower court. Talent is needed. After becoming a district judge, they came to the Supreme Court as judges. And here, many people work as laborers in Saudi Arabia or go to London with a certificate in the judge's court. Then came back and was listed in the High Court. Then became a judge of the High Court. Because there is no law. Cannot appeal with third division in lower court. And here you have to make a team. The constitution mentions an independent judiciary. Why do they remain subordinate? They support the government that comes.
He also said that Bangladesh has been going without voting for 16 years. Now wants to reform. What will you reform? Those who were DC, UNO, helped to steal votes. Have you taken action against them? It has been 2-3 months today. Punish them. Teachers were the presiding officers. Find them. The government that comes in amends the constitution as per their convenience. Once the constitution changed for one person. Why? Constitution is a document.
Dr. Shahdeen Malik said in his speech, what we are hearing about constitutional reform, it seems that we are moving towards a new type of government system. In 52 years as me, we have changed the system of government 12 times. And this time it will be the 13th time. Our concept of constitution is not yet mature.
Professor Syed Anwar Hossain said, the unelected government can make recommendations, not reforms. The power should be in the hands of the elected government. There are still many mistakes in the constitution. These also need to be fixed.
In the President's speech, Subrata Chowdhury criticized the exclusion of Constitution Day from the list of National Days on November 4. He said to the interim government, he has done 10 reform commissions, done reforms. But how are the judges appointed before the policy? 15 judges outside the court on what basis? These should have answers.
