Pakistan on Thursday announced the cancellation of the Shimla Agreement signed with India in 1972. Along with this, he closed the Wagah Border and stopped all types of movement to and from India. Pakistan has also closed its airspace to Indian airlines. This decision has been taken in response to India taking strict action against Pakistan after the terrorist attack in Pahalgam, Jammu and Kashmir. India had also suspended the Indus Water Treaty on April 23, which Pakistan has now seen as its retaliatory move.
What is Shimla Agreement?
The Shimla Agreement was a historic bilateral treaty between India and Pakistan, signed on 2 July 1972 by the then Prime Minister of India Indira Gandhi and the President of Pakistan Zulfikar Ali Bhutto in Shimla, located in the hills of Himachal Pradesh. This agreement was reached after the 1971 war, in which Pakistan suffered a major defeat and Bangladesh became an independent country. The purpose of this agreement was to normalize relations between the two countries and chart a peaceful path for the future.
Key points of the agreement
1. Peaceful resolution of disputes:
India and Pakistan had agreed that they would resolve mutual disputes through dialogue and no third party would be involved. This simply meant that there would be no international interference on the Kashmir issue.
2. Respect for sovereignty and integrity:
Both countries had agreed to non-interference in each other’s borders, political independence and internal affairs.
3. Redefinition of the Line of Control (LoC):
The 1971 ceasefire line was named the ‘Line of Control’ and both sides agreed not to change it unilaterally.
4. Restoration of diplomatic relations:
It was also decided in the agreement that both the countries would restart mutual dialogue, trade, travel and cultural relations.
5. Release of prisoners of war:
India had released more than 93,000 prisoners of war from Pakistan under this agreement, which is considered to be the largest prisoner of war release after the world wars.
How did both countries reach the agreement?
The 1971 war started due to the political crisis and civil war in East Pakistan (now Bangladesh). India intervened on humanitarian and strategic grounds and Pakistan had to surrender in Dhaka on 16 December 1971. After this defeat, international and internal pressure on Pakistan had increased a lot. The Shimla Agreement was a means to overcome this situation, so that Pakistan could try to get back the land and prisoners of war under its control.
The talks held in Shimla were very long and complex. There were differences especially regarding Kashmir, because India wanted all issues to be resolved through mutual dialogue, while Pakistan wanted to maintain the freedom to raise Kashmir in international forums. Eventually, a compromise was reached during late-night meetings and a private dinner between Indira Gandhi and Bhutto. The mention of Kashmir in the agreement was limited and emphasis was laid on bilateral talks.
What happened after the agreement?
Shimla Agreement definitely became a diplomatic framework, but tension remained in India-Pakistan relations. Kashmir issue could not be resolved and this was followed by Siachen conflict (1984), Kargil war (1999) and many terrorist incidents. Even today, India cites this agreement in international forums to reject third party arbitration, whereas Pakistan interprets it differently and has many times sought international intervention.
Even today, the Shimla Agreement is included among the documents considered to be the foundation of India-Pakistan relations. It not only decides the validity of the Line of Control (LoC), but is also the core of India’s diplomatic policy. However, due to continuous border tension and lack of dialogue, questions are now being raised on the effectiveness of this agreement.
Now that Pakistan has officially canceled this agreement, relations between India and Pakistan have taken another serious turn. In the coming days, it will be very important to keep an eye on the direction of dialogue and relations between the two countries.
