Although the Supreme Judicial Commission Ordinance was issued on March 7 for the appointment of a judge in the High Court during the last caretaker government, the Awami Fascist government did not pass the law in Parliament for the use of the judiciary as a party tool. “
He made the claim at a press conference on Monday (January 26th) on the 'evaluation and review of the Reformation Ordinance on the judiciary'. AB Party general secretary Barrister Asaduzzaman Fuad spoke at a press conference held at the party's central office.
'Independent judicial system is an essential condition of our national progress. In view of that, the current interim government has issued “Ordinance 2021 on the appointment of Justice” on January 25. This ordinance will make the appointment process of the High Court transparent and accountable. '
At the beginning of the press conference, Barrister Fuad said, “We welcome the government's initiative on the judiciary reform and the appointment of the High Court judge.” But the lower court PP, APP appointment has no transparent process. Likewise, we think that a law student cannot be appointed by the BGS exam in the lower court. At least 5 years of experience as a lawyer to get a judge appointment must be made compulsory. Otherwise, problems are being created in the lower court.
At a press conference on the judiciary reform, Barrister Zobair added, “We welcome the initiative that the Separate Secretariat and Permanent Attorney Service announced for the Supreme Court at the press conference recently.” The AB Party has been making this claim for a long time.
He said the people would partially benefit from this reform initiative. If there are no more reforms, including the reform -implementing agencies and the Bar Council, this ordinance will not get the desired justice from the judiciary. In order to ensure justice, the police cannot play the role of the police without an investigation in the trial of criminal offenses; Avoid longevity, the investigation report should be submitted in time.
In the current ordinance, only those associated with the legal profession have been made members of the council. The AB party thinks the presence of the common people in the recruitment process of judges in various common law systems in the developed world is compulsory, so the inclusion of representatives of the people is essential to balance the legal perspective and the view of the people. In order to appoint a judge of the Appellate Division, it is important to make five instead of quorum members in transparency.
Referring to the constitutional challenge to determine the age limit, Barrister Zubair said that instead of setting the age limit, it is important to implement the qualifications in accordance with the constitution. There, the interview evaluation method needs to be publicized, the talent, experience and integrity of the candidates need to be emphasized.
He said the judiciary would have to be zealous to cut off more than 5 lakh cases. In that regard, it is important to form a judicial administration at every level, set the limit of appeal, to force the defeated party to take responsibility, to extend the alternative dispute settlement system to the union or upazila under the judicial secretariat.
Barrister Zubair demanded the formation of a permanent 'criminal case re -evaluation commission' to settle millions of false and harassing cases.
'Party politics must be stopped in the court premises. The procession, meetings, slogans, banners, posters will have to come out of the culture of the court. In that case, every time arrangements should be made to separate the judicial court border. '
