Chief Justice of the country D.Y. Some lawyers have written a letter to Chandrachud complaining about the judges. He says that action should be taken against such judges who reprimand the lawyers during the hearing or say such things which insult the lawyers. Many other associations including Madras High Court Advocate Association, Tamil Nadu Bar Association and Puducherry Bar Association have written letters to CJI Chandrachud expressing their displeasure over this attitude of the judges.
The lawyers demand that a committee should be formed, which will ensure that the judges will not insult the lawyers like this every day and will speak in respectable language. It was written in the letter that some judges consider lawyers inferior to themselves and because of this they shout at lawyers and do not maintain etiquette while talking to them.
This matter came into discussion on October 1 after a video clip of the Madras High Court went viral. High Court Justice R. Subramaniam and Justice L. Victoria Gauri's bench was hearing a case. In the video clip, Justice Subramaniam is seen reprimanding senior advocate P. Wilson. Justice Subramaniam was seen in the video accusing Advocate Wilson of playing tricks and getting him removed from the case. During this time, Advocate Wilson also tries to apologize several times, but the judge flatly refuses to listen to his matter.
During the hearing, Advocate Wilson had suggested to the bench that Justice Gauri should recuse herself from the case. The bench was hearing several appeals and PILs filed in 2018 and 2024 regarding recruitment in the Tamil Nadu Public Service Commission (TNPSC). Advocate Wilson, appearing for TNPSC, said in the hearing that Justice Victoria Gauri should be removed from the hearing because she has accepted the writ petition and has also issued guidelines.
Reprimanding Advocate Wilson, Justice Subramaniam said that this is a very irresponsible statement and the advocate wants that Justice Gauri should be removed from the case because he gave an interim order on the writ petition while the petitions are still pending. The judge said that this is an insult to the court and he will not hear the case and he directs the registry to transfer the case to the Chief Justice.
After the video surfaced, many times the lawyers of the association came in support of Senior Advocate Wilson and they appealed to the Chief Justice of Madras High Court. Sriram and Supreme Court Chief Justice D.Y. Wrote a letter to Chandrachud. It was written in the letter, 'Lawyers and judges have equal rights and stake in the administration of justice, but some judges have the misconception that lawyers are their subordinates. Because of this, he shouts at the lawyers during the hearing, speaks inappropriately and belittles them. Also, he does not take care of etiquette while talking.
