Tahawwur Rana, accused of the terrorist attack on 26 November 2008 in Mumbai, has appealed in the US Supreme Court against extradition to India. On August 15 this year, the US Federal Court had given its decision to send Tahawwur to India under the India-US extradition treaty. Rana has reached the Supreme Court against this decision.

Rana, a Canadian businessman of Pakistani origin, had filed a petition in the Federal Court Ninth Circuit last year. He had requested that he not be handed over to India till the hearing, which was rejected. Even in May 2023, an American court had rejected the petition filed by Rana.

Now if the Supreme Court also rejects Tahawwur's appeal then he will not be able to appeal further. After this Tahawwur can be brought to India. Tahawwur is accused of funding the Mumbai attacks.

Last year also the court rejected the petition against extradition To avoid being handed over to India, Tahawwur Rana of Pakistani origin had filed a Habeas Corpus petition in the US court. Habeas corpus petition is used when a person is kept in illegal custody.

After this, the District Court of Los Angeles had said in its decision that considering the allegations on the basis of which India has demanded the extradition of Tahawwur, his extradition can be allowed.

After the verdict against him, Rana had filed another petition in the Ninth Circuit Court. The decision on this came in August. In this, the rejection of the habeas corpus petition was justified. The panel held that Rana's crimes fall under the terms of the extradition treaty between the US and India.

The panel acknowledged that India had provided solid evidence of the allegations against Rana regarding the attack. Now Rana has appealed against this decision in the Supreme Court.

Tahawwur is a childhood friend of attack mastermind David Headley. During the court hearing last year, government lawyers had argued that Tahawwur was a childhood friend of David Headley, the mastermind of this attack, and he knew that Headley was working with Lashkar-e-Taiba. By helping Headley and providing him financial assistance, Tahawwur was supporting the terrorist organization and the terrorists along with it.

Rana had information about whom Headley was meeting and what he was talking about. He also knew the attack planning and the names of some targets. The US government has said that Rana was a part of this entire conspiracy and there is every possibility that he has committed the crime of funding the terrorist attack.

Rana may come to India, doubts over Headley

Headley was arrested by US authorities in October 2009 and sentenced to 35 years in prison for his involvement in the Mumbai attacks. There is a provision in the extradition treaty between India and America that if a person commits a crime in India and if he is caught on American soil, then India can demand his extradition.

According to many reports, Headley had made a deal with America that he would fully cooperate with them, provided he was not extradited to India or Pakistan.
