'Trying to change election results' case against Trump dismissed


A federal judge has dismissed a lawsuit filed against US President-elect Donald Trump for trying to change the 2020 election results. On Monday (November 25), Judge Tanya Chutkan dismissed the case without a final decision. That means the case could be reopened after Trump finishes his second term. The British media reported the news.

US special counsel Jack Smith urged the court to dismiss the case. He applied to dismiss the case citing judicial principles. According to that policy, no criminal case can be filed against a sitting president.

Along with this, Jack Smith filed a motion to dismiss the case filed against Trump for allegedly keeping secret government documents after his first term as president.

Trump has been claiming that he is innocent in these two cases. Jack Smith has fought two cases against Trump for so long.

“Under the United States Constitution, indictments and subsequent criminal prosecutions against a sitting president at the federal level are prohibited,” Smith said in the filing.

That is, according to the rules of the US Department of Justice, if Trump takes office after winning the election, the case against him must be dismissed.

Several lawsuits were filed against Trump after his first term as president. Among them, he has also been convicted in a case related to bribing a former porn star. However, Trump has claimed on his social media, Truth Social, that these cases have been filed against him for political reasons.

Earlier this year, he had about 100 criminal charges against him. But in the summer, the Supreme Court ruled that he cannot be impeached for 'official activities' while serving as president.

After winning the 2024 elections, almost all the allegations were dismissed. A Georgia state lawsuit is currently pending, however.

Trump has promised to fire Jack Smith immediately after taking office.

In 2022, Attorney General Merrick Garland placed Smith in charge of the investigation. He said he plans to resign next year.
