Penalties that government employees can face if they do not declare their assets


Currently, the number of government employees in the country is about 1.5 lakh. All of them have to submit the statement of assets by November 30. But after that it has to be submitted by December 31 every year. This was reported by the Ministry of Public Administration on September 1.

As per BB-63 of the Government Servants (Conduct) Rules, 1979 (as amended on 30/12/2002) in order to prevent corruption and establish good governance by ensuring transparency and accountability of Government servants, filing of asset-statement is mandatory for all Government servants.

On September 1, 2024, after the current interim government took over, a press release was issued by the Ministry of Public Administration, instructing all government employees to submit asset statements.

Deadline for submission of asset-statement: All government employees are required to file their asset-statement by 31st December of every financial year. Asset-statement to be filed by 30th November 2024 in respect of financial year 2023-24 only.

Authority to be filed with:

A. Cadre/Non-cadre (Grade IX or above) officer shall submit asset-statement to the Secretary of the Administrative Ministry/Department through his controlling authority.

b. Gazetted/Non-Gazetted Officers/Employees (10th Grade to 20th Grade) shall submit their asset-statement to the respective appointing authority.

Submission Process:

The asset-statement has to be submitted in the prescribed table prepared by the Ministry of Public Administration. Six public administrations

A) It can be collected from the own website of other ministries/departments/departments/organizations including the Ministry.

b) The statement of assets should be submitted to the concerned authority in a sealed envelope.

Number of Government Servants: According to the Bangladesh Bureau of Statistics, more than 70 million people in the country are engaged in various types of jobs and work-oriented activities. Among this huge number of people, the number of government employees is only 1.5 lakh. And on January 24, 2023, in response to the question of Shamsun Nahar, Member of Parliament for reserved women's seat, the then Minister of State for Public Administration, Farhad Hossain told the parliament, 'According to the Statistics of Civil Officers and Staffs 2021 report, the number of government employees in the country is 15 lakh 54 thousand 927.'

Penalty for non-filing of asset-statement: In case of failure to submit asset-statement within the stipulated time or any wrong information or concealment of information or any discrepancy in assets is observed, departmental action will be taken as per Government Servants (Conduct) Rules, 1979.

Applicability: These regulations shall apply to all Government servants.

Privacy Policy: A. Asset-statement information is not transferable in whole or in part without court order and approval of concerned authority.

b. The Right to Information Act, 2009 will not apply in this case as asset-statements are highly confidential documents.

Changes and Modifications: Government reserves the right to modify and amend these rules from time to time as per need.

Penalty for not submitting statement of assets: Sub-rule 4(5) (c) of the Government Servants (Discipline and Appeal) Rules, 2018 provides for the imposition of any minor or capital punishment specified in sub-rules 4(2) and 4(3) of the said rules for 'misconduct'.

4 (2) The penalty mentioned in clause is as follows:

A. reproach;

b. Withholding of promotion or increase in salary for a specified period, except in the case of disqualification for promotion or increase in financial benefits as per the rules or orders relating to the post or post;

c. To recover the whole or part of the financial loss of the Government caused by neglect of duty or disobedience of Government orders, from salary or gratuity; or

d. Demotion to a lower step in pay grade.

The penalties mentioned in 4(3) are as follows:

A. Demotion to a lower post or lower pay grade;

b. Compulsory retirement payments;

c. removal from employment;

d. Can be dismissed from the job.
