Supreme Court Stays NCPCR Communication On Shifting Of Students Of Unrecognized Madrassas To Govt Schools – Amar Ujala Hindi News Live

The Supreme Court took a big decision on Monday. It has put on hold the decision to transfer all students of unrecognized madrassas to government schools and remove non-Muslim students from madrassas.

Who filed the petition?

Jamiat Ulama-e-Hind had filed a petition against this order of Uttar Pradesh and Tripura governments. This order of the Uttar Pradesh government was based on the report of the National Commission for Protection of Child Rights (NCPCR). In this, it was asked to cancel the recognition of madrassas which do not follow the Right to Education Act 2009 and to investigate all the madrassas.

A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra took cognizance of the submission of senior counsel appearing for Muslim organization Jamiat Ulema-e-Hind that the communications of the National Commission for Protection of Child Rights (NCPCR) and some There is a need to stop the actions of the states.

UP government had given this order

The court stayed the order of Uttar Pradesh and Tripura governments directing them to transfer non-Muslim students studying in unrecognized madrassas and government-aided madrassas to government schools. The Supreme Court has put on hold the NCPCR's recommendation and action taken by the Center and states to close government-aided/aided madrassas for non-compliance of the Right to Education Act.

The Supreme Court directed that the communications issued by NCPCR on June 7 and June 25 be stayed till June 27 and all steps taken thereafter. The bench also said that consequential orders of the states will also be stayed.

The court also allowed the Muslim organization to make states other than Uttar Pradesh and Tripura as parties to its petition.
