Supreme Court on Yasin Malik: The central government opposed taking terrorist Yasin Malik to Jammu court for trial. The Supreme Court said that it will consider setting up a special court in the jail itself. The court has asked the government to file a new petition by making other accused related to the case also parties. The next hearing of the case will be on November 28.
This matter is pending in the Supreme Court since 2022. Then the CBI had challenged the orders of the Special TADA Court of Jammu, in which Yasin Malik was asked to be produced personally in two separate cases. The Jammu court had issued this production warrant in September 2022 in the Rubia Saeed kidnapping case and the murder of four Air Force officers.
CBI's petition
CBI had said in its petition that Malik, who is lodged in Delhi's Tihar Jail, cannot be taken to Jammu due to security reasons. The Supreme Court had stayed the order of Jammu Court in 2022 itself. On Thursday, November 21, 2024, the Supreme Court bench of Justices Abhay S Oka and Ujjwal Bhuiyan heard the case. Solicitor General Tushar Mehta appeared on behalf of CBI and Central Government.
Solicitor General said Yasin Malik is not an ordinary terrorist. He has big contacts in Pakistan. Due to security reasons, it would not be right to take him to Jammu. On this, Justice Oka said, 'If he does not appear in the court, then how will his cross-examination take place? This cannot be done through video conferencing. Anyway, the internet network in Jammu is not very good.
Yasin Malik wants to go to Jammu
Justice Oka also said that 'Ajmal Kasab was also given a fair trial in this country'. On this, the Solicitor General said, 'This is not a case in which everything written in the law books should be followed exactly. We had offered to arrange legal representation for Yasin Malik in the court, but he is not ready for it. Wants to go to Jammu himself.
Mehta further said, 'We are also concerned about the safety of witnesses in the case. Earlier, a witness had also been murdered. On this the judges said that creation of a special court in the jail itself can be considered. But for this other accused will also have to be heard. Tushar Mehta said that he will file an amended petition by making all the accused a party. The court asked him to do so within a week.
