An appeal challenging the telecom tariff orders of the Telecom Regulatory Authority of India (TRAI) was dismissed by a bench of Justice P S Narasimha and Justice Sandeep Mehta of the Supreme Court. The Court upheld the decision of the Kerala High Court in this regard and said that such matters should be resolved in the telecom tribunal TDSAT.

New Delhi. The Supreme Court rejected an appeal challenging the telecom tariff orders of the Telecom Regulatory Authority of India (TRAI). The court upheld the decision of the Kerala High Court in this regard and said that such matters should be resolved in the telecom tribunal TDSAT. Earlier, the Kerala High Court had challenged Indian Broadcasting Corporation against certain provisions of the Telecommunication (Broadcasting and Cable) Services Interconnection (Addressable Systems) Regulations, 2017 and the Telecommunication (Broadcasting and Cable) Services (Eighth) (Addressable Systems) Tariff Order, 2017 issued by TRAI. And had refused to consider the petition of Digital Foundation (IBDF).

The court had said that IBDF should have approached TDSAT (Telecom Disputes Settlement Appellate Tribunal) for review of the tariff orders. A bench of Justices P S Narasimha and Sandeep Mehta, while dismissing the plea, said, under the rules, tariff orders can be challenged before the TDSAT. The Court also said that challenges to the rules can be later appealed to this Court through statutory appeal under Section 18 of the TRAI Act.

IBDF, in its plea, cited the apex court's 2014 judgment in the BSNL vs TRAI case and said it limited TDSAT's authority to review TRAI rules, thereby creating ambiguity about jurisdiction. The bench accepted the plea and clarified that IBDF can approach TDSAT for fee related disputes and the latter can adopt statutory remedies if necessary.
