Appeal by the State party against the order to ban battery operated rickshaws


The state has filed an appeal against the High Court's order to stop the operation of battery-powered auto-rickshaws in the Dhaka metropolitan area. Sources of the Attorney General's office informed that this application was submitted to the relevant branch of the Appellate Division on Monday (November 25). A hearing on this matter is scheduled to take place in the Appellate Division Chamber Judge Court at noon.

Earlier on Sunday (November 24), Deputy Attorney General Noor Muhammad Azmi told the media that we are preparing a petition against the order of the High Court. I can present the application to the Judge in Appellate Division Chamber Judge Court today or tomorrow.

He said that the stay petition will state that allowing the operation of battery-powered rickshaws or auto-rickshaws is a policy decision of the government and therefore the High Court cannot interfere with this decision.

To reduce road accidents on November 20, the High Court directed the relevant government authorities to take necessary steps to stop battery-powered rickshaws and auto-rickshaws on the roads of Dhaka within three days.

It also issued a ruling to explain why their failure to stop the operation of these vehicles should not be outlawed.

The bench of Justice Fatema Najib and Justice Sikder Mahmudur Razir gave this direction in view of a writ petition filed by the Greater Dhaka City Corporation Rickshaw-Owner-Union.
