Karnataka High Court Said Shouting Jai Shri Ram in Mosque Didn't Outrage Religious Sentiments


Karnataka High Court On Jai Shree Ram Slogan: Karnataka High Court, while hearing a decision, said that raising slogans of 'Jai Shri Ram' in the mosque has not insulted the religious sentiments of any community. On this basis, the court has dismissed the criminal case going on against two accused (Kirtan Kumar and Sachin Kumar). This case was registered in Dakshina Kannada district of Karnataka in September last year.

In the case, the complainant had alleged that both the accused entered the mosque one night and raised slogans of 'Jai Shri Ram'. On this, the police had registered a case under sections 295A, 447, and 506 of the Indian Penal Code (IPC). A bench headed by Justice M Nagaprasanna said, “Section 295A deals with offenses that intentionally and maliciously insult the religious sentiments of any community. Raising slogans of 'Jai Shri Ram' is likely to outrage religious sentiments of any community. Has not been hurt.”

The court rejected the state government's argument

The state government had demanded further investigation in this matter but the court rejected it. The court said that nothing has come to light in this case which could have had any negative impact on public order or peace. The court also said that continuing with such cases without any solid reason would be an abuse of the judicial process and could lead to miscarriage of justice.

'Can't give permission like this, it will be a miscarriage of justice'

According to 'Bar and Bench', a website related to legal news, the court said, “The apex court said that no kind of crime can be proved as a crime under section 295A of the IPC. The crimes which involve breach of peace or public order. Putting them in danger would not amount to an offense under Section 295A of the IPC. In the absence of concrete evidence or elements of any alleged offence, allowing further proceedings against these petitioners would be an abuse of the process of law. “As a result there will be a miscarriage of justice.”
